the said の the は省略されることが多くないですか？以下のサイトでも定冠詞氏がついていない。

この aforementioned の意味で用いられるsaidは、実務で契約文書等を見る限りにおいては、省略はあったりなかったりですね。

蛇足ですが、個人的には、この語は嫌い（何か古っぽい感じが・・・）で法律文書では私は使用しません。this, the　などで表します。

aforementioned が使われる場合は the は省略できませんよね？間違っていたらごめんなさい。

I agree with you. It is also my observation that, unlike "said,"

"aforementioned" is usually used with "the" preceding it in legal documents. However, I guess we could find the use of "aforementioned" without the definite article in such documents, as is the case with "said." You may go on-line to check it out.
