by these presents は結構多用される決まり文句で「本契約書により」ですね。presents とは名詞で、記載された契約条項や文言全てを指すようです。要するに「この契約書に書いてあることが取引・関係の根底だよ。当事者パーティはこの契約書の条項に従ってね」という話だと考えます。
