どちらの英訳が良いでしょうか？

専門用語が多いのですが、言葉の選び方は、両方の英文で
同じです。 文のつなぎ方、または論点の見せ方が少々違います。


元の日本語

「あなたのご指示の通り、クレーム5（claim 5) に従属していないクレーム2と4（claims 2 and 4) を新たにクレーム5に従属(depend from)させると、通知（Office Action）に対する補正（amendmet)で認められていない クレーム追加に該当するため、拒絶される可能性が高い」

1.If the dependencies of the claims 2 to 4 which do not currently depend from claim 5 are changed so that the claims 2 to 4 depend from claim 5, it would be considered that these changes apply to an addition of a claim which is not accepted for a response to an Office Action. Accordingly, we think it would be highly possible that your instructed amendment will be rejected.

2 We think it would be highly possible that your instructed amenement will be rejected because changing the dependencies of claims 2 and 4 which do not currently depend from claim 5 so that the claims depend from claim 5 would be considered an addtion of a claim which is not accepted for a response to an Office Action.

これは特許法17条の2第3項若しくは同5項の新規事項禁止の要件に抵触する可能性がある、と言っているのですか？ もしそうだとすると、そもそも日本語の原文が法的に不正確であり問題だと思います。

しかし、法律論を抜きにして考えるとすると、2 の方がいい気がします。

ただ、以下のように修正した方がいいと思います。
"your instructed amenement will be rejected 〜 " → "the amendments which you require will be rejected 〜"　
so that the claims depend from claim5 も in order for these claims to depend from claim5 にした方が読みやすいと思います。

ありがとうございます。私は訳す方の仕事をしていますが、特許法の勉強もしているのでおっしゃることには
同意してしまいます。やはり、この日本語の内容がおかしいですよね。本当は最後の拒絶理由通知に対するコメントなので、
17-2（5）が該当する条文になるはずなのすが、私の所へ回ってきた日本語は上記でした。 addition of a new matter は新規事項の追加となり、頻繁に登場するフレーズです。おっしゃるとおりです。うちの技術スタッフはこの程度の駆け出しも
おります。すみません。しかし、英語担当なのでその辺りは口出ししておりません。あくまでいただいた日本語に沿うのみです。addition of a claim （クレームの追加）という文言は今日初めて見ました！

そして私の英文は2であり、それを無理やり1に直してしまいました。自分の英文はどこがどうだめなのかは
わからないため、教えていただこうと思いましたが、やはり1は違うのではないかということをうかがって少々楽になりました。ちなみに、現地からきた指示の文章が、The dependencies of the claims 2 and the claim 4 claim 5 so the claims depending from the claim 5 という一文を使っていたので、それを使わせてもらいました。

みました。ご参考までに。

「あなたのご指示の通り補正すると拒絶される可能性が高いと思います。
理由は、クレーム5に従属していないクレーム2と4を新たにクレーム5に
従属させると、通知に対する補正で認められていないクレームの追加に該当する
と見做されるためです。」


It would be highly possible that the amendment following your instruction
will be rejected (by the patent office).
The reason is, when the claims 2 and 4 that are independent of the claim 5
become dependent from the claim 5, it is regarded as an addition of a new
claim that is not permitted in response to an Office Action.

しかしながら、この場合、independent of claim 5 という表現は
実務上使わない表現なんですよね。それとも、そんな使い方は私が
知らないだけでアリなんでしょうか。

independent claim が独立クレームという基本の考え方があるのでね。。。

特許は専門ではないので細かい所はよくわかりませんが、誰かに（依頼人等）に対する回答とすると1は日本人っぽい文章で不自然ですね。

2がましですが、さすがに文法がちょっとごちゃごちゃすぎてて多分何言ってるのか良くわからんと思います。文章を分ける必要もあります。というわけで、2を基本に、一応日本語の文章を出来るがぎり損ねないようにすると自分だったら以下のような感じじゃないかな〜と思います。

We consider it is likely rejected (it will not be accepted) if we submit the amendments as you required. The dependencies of the claims 2 and the claim 4 are not currently from the claim 5, so the claims depending from the claim 5 would be considered to be an addition of a (new) claim that is not accepted for a response to an Office Action. (根拠となる条文の箇所を提示)
